Overview of Texas Criminal Defense Statutes

The United States and Texas Constitutions act to guide and limit the Government's ability to enforce criminal offenses against the people. Not every law that the legislature passes will meet constitutional requirements and occasionally a law that itself is constitutional can be unconstitutional as applied to a particular person. The Texas Legislature must pass a law in order to create a criminal offense, and a criminal lawyer will carefully consider and explore whether the law is being properly enforced.  If it is not the attorney will challenge this in court to protect your rights.  

All of the offenses in the Texas Penal Code, as well as various other Texas statutes are listed below. The list starts with the Penal Code, which is the main source of Texas criminal laws which are numbered sequentially in the Penal Code.  The Penal Code groups categories of offenses together and I have listed links the categories below so that you can skip ahead to that specific area of law.
