Overview of Federal Criminal Offenses

“Federal crimes” refer specifically to offenses that violate U.S. federal laws that were passed by the U.S. Congress and signed into law by the President. They are investigated by state and/or federal law enforcement but they are prosecuted by United States attorneys in federal courts with federal judges. While many of these offenses are distinctive to the federal system, they also include crimes that would otherwise fall under state or local jurisdictions.

In order for a crime to be properly enacted as a federal crime, there must be some link to "federal" interests, rather than purely local interests.  The most common federal interest used to justify federal criminal laws is the "commerce clause."  For example, in order to charge a felon in possession of a firearm case in federal court, the federal authorities must establish that the firearm somehow moved in interstate commerce or affected interstate commerce.  Another source of federal jurisdiction is territorial jurisdiction.  If a person commits a crime on federal property such as a federal courthouse, a military installation or a corps of engineers park, they can be prosecuted federally.  In fact, the U.S. Code contains an "assimilative crimes" act which allows federal authorities to prosecute pure state law violations in federal court as federal law violations.

In Texas the vast majority of criminal offenses are set out in the Texas Penal Code.  Federal Laws are listed differently-there is no federal "penal code."  Instead, all federal laws are contained in the United States Code which contains many more federal laws than just criminal offenses.  The main sections of the U.S. Code dealing with federal crimes are Title 18 and Title 26 of the United States Code.  There are many other sections of the U.S. Code that also contain criminal provisions.  The extensive list of federal crimes below is compiled from Titles 18 and 26 of the U.S. Code:
